Purchase rules
Right of complaint
The right of complaint is the customer's right to complain about a product, that has faults or defects, that were present when the product was sold. The customer has two years to find faults or defects in the goods, which evidentially is the responsibility of the dealer. The burden of proof lies with the dealer the first 6 months and the following 1½ years with the customer. The right to complain is the customer's legal right.
Warranty
Warranty is a special agreement entered into between buyer and seller. If the customer and the dealer agree that there must be a two-year warranty for an item, the customer is allowed to complain about all types of faults and defects during this period. If so happens, it is the responsibility of the dealer to prove the error is due to non-compliance by the customer. Warranty is not the customer’s legal right.
Reasonable time
The costumer always has two months too react, after a fault or defect in a product has been discovered. Complaints within 2 months are therefore considered to be within a reasonable time and thus in accordance with the law. Complaints made later than two months may still be considered within a reasonable time, but this must be assumed to be a rarity.
The rule of presumption
The rule of presumption states that within the first 6 months after a purchase, it is presumed that a possible defect or fault with a product, was present at the time of purchase. In practicality, this means the consumer is ensured a lighter burden of proof within the first six months and thereby has an easier time exchanging the goods.

You can also complain about a product or service purchased from us to the Danish Competition and Consumer Authority's Center for Complaint Resolution, Carl Jacobsens Vej 35, 2500 Valby. You can complain to the Center for Complaint Resolution via www.forbrug.dk.
If you live in another EU country, you can submit a complaint to the EU Commission's online complaints portal. This is particularly relevant if you are a costumer residing in another EU country than Denmark. Complaints are lodged here – http://ec.europa.eu/odr. When submitting a complaint, you must indicate our e-mail address mail@epicpanda.dk.
Trading terms for private customers
The following sales and delivery terms apply to all deliveries from epicpanda.dk. The conditions apply in the case where a general purchase has been made via the website and no other written agreement has been entered into.

Shipping Data
It is the customer's responsibility that all data they provide to Epic Panda when placing an order is correct. Epic Panda cannot be held responsible if you as a customer have submitted incorrect data.
Documentation and instructions
If there are product descriptions and user instructions for the item, these are included with the delivery from Epicpanda.de. If you want further information or advice from us, this is for guidance only.
VAT
19% VAT is charged on all purchases of new products ordered from Germany and sent to Germany.
When buying from abroad, VAT may be imposed from the country you buy from.
Profit margin scheme for used items, the buyer does not have a deduction for the VAT, these goods will be marked with (recycling)(Genbrug) or (BMO) which stands for the Danish words for used margin scheme
Delivery time and transport
Delivery of goods purchased in epicpanda.de is considered to have taken place when the buyer have received the item. Goods are normally shipped with GLS.
Normal delivery time is 2-3 days. Transport will be longer to countries other than Germany.
Delivery on pre-orders
As a rule, we do not split orders up, so if you order a combination of pre-orders that are released at different times and/or stocked products in the same order, everything will be sent when the last product is released or received in our warehouse. So if you want to order several products that are released on different days and want them to arrive by their different release dates, then you must place an order per product/release date.
Payment for pre-orders
As a rule, we never deduct the money from a pre-order before your order is dispatched if you pay with Credit card.
However, when paying via Paypal, we withdraw the money shortly after the order has been placed, it remains in our PayPal account until your order has been dispatched. We do this because Paypal max allows us to withdraw the money 30 days after an order has been placed.
The risk for the goods
The risk for goods purchased in Epic panda passes to you as a consumer at the time of delivery.
Complaint
Any errors or deficiencies in delivery from Epicpanda.de must be claimed within a reasonable time after you have discovered the error. It is your duty to indicate and, on request, show how the error or deficiency manifests itself. If you discover an error, you must quickly contact Epicpanda.de either via e-mail support@epicpanda.dk or by tel. +45 42501918. As a customer of epicpanda.de, you have 24 months right of complaint after you have received the goods. For goods with a limited shelf life, your right of appeal is limited by the shelf life period that Epic panda has given you.
Unless otherwise stated, all goods on Epicpanda.de's website are subject to a 24-month right of complaint. The burden of proof for errors or omissions lies with Epicpanda.dk for the first 6 months, and with the customer for the following 18 months.
All demo items have a 3-month right of return, unless otherwise stated.
If the customer wishes to report errors or deficiencies, this must be done in writing to epicpanda.de no later than 60 days after the error or deficiency has been discovered. The customer must give epicpanda.de a reasonable opportunity to inspect the item in question. epicpanda.de is not responsible for further damages or damages as a result of continued use after errors or defects have been discovered, or if the customer changes or repairs the product without permission from epicpanda.de
Epicpanda.de's responsibility in the event of a complaint is limited to the repair or exchange of a defective item, or refund of the price of the item. Damage to a product, caused by incorrect use, modifications or gross abuse by the customer, is not covered by the right of complaint. Epicpanda.de cannot be held responsible for loss of data or other indirect consequences as a result of a defective or defective product sold by Epicpanda.de.
Application of the right of complaint
Complaints regarding errors and defects must be notified to Epicpanda.de within a reasonable time after receipt of the goods. The customer is asked to make a statement about the product's fault or deficiency in connection with the complaint, as failure to do so may mean an extension of the remedial process due to fault finding. Goods that are not covered by the right of complaint will be returned at the customer's expense. Goods returned on cash on delivery or otherwise sent with missing postage are refused receipt by Epicpanda.de
Returned goods without errors
When an item is returned to epicpanda.de, where an error or defect, defined and specified by the customer, is not found, the item will be returned to the customer. Goods must be returned with an invoice/order confirmation/receipt copy, where the time of purchase for the complained about product appears, as well as a description of the fault, as the item will otherwise be stored until the invoice/order confirmation/receipt copy is available, and error notification on the product.
Safe return
All goods that are returned must be securely wrapped. Damage as a result of poorly packaging may cause your rights to expire. If a product purchased at epicpanda.de is received wrapped in antistatic material, in the event of a return, it must also be wrapped in corresponding antistatic material. If a returned item has been damaged due to lack of packaging, this could result in the loss of your rights, depending on whether the item has been damaged.
Used goods
We provide the same guarantees and complaints on used goods as on new goods.
if one-time codes are usually included for a game or other used product, then these codes may have been used and Epic Panda ApS does not replace these or does not see this as a complaint case since the item has been used and it is natural that these one-time codes can already be used by a previous owner.
Right of withdrawal
Your cancellation period starts from the day you receive your item. You must have addressed an inquiry to us via email within the right of withdrawal period. You must bear the costs associated with returning the item to Epicpanda.de. In case of refusal to receive a package from Epicpanda.de, postage and return postage will be deducted from the customer's purchase amount as this is seen as a cancellation of the purchase.
When picking up an item, there is no cash right of return, as you have the opportunity to examine the item before the transfer/transfer of risk takes place.
The full price of the goods will be refunded within 30 days, we will also pay the original shipping price you paid to us at the time of purchase if the entire order is returned, in accordance with § 12c of the Consumer Contracts Act, provided that the product complies with regulations on condition. 14-day right of return
When you buy an item online, you always have a 14-day right of cancellation.
The package must be sent by delivery to business.
The package must be clearly labeled "14 day right of withdrawal". Returns due to regret are at the buyer's own expense. It is recommended that the item be returned as parcel with tracking, This removes any doubt as to whether the item has been delivered to Epicpanda.de. Furthermore, the customer has the option of calling for the package if delivery has not taken place. Goods that are returned on cash on delivery or that are sent without postage are refused to be received by Epicpanda.de

Add-on 365-day right of return
In your basket, you have the option to purchase a 365-day right of return per product instead of just 14 days. You can select the option for each product line and pay for each simple product. In other words, if you buy 2 identical products, you will be charged 1 Euro per product. However, the same rules for the right of return apply with a few individual exceptions. original postage will not be refunded, if you have paid with paypal, we will only refund through bank transfer, payment fees will not be refunded and we will deduct our bank transfer costs from the amount if it is to a foreign account.
Extended Christmas gift exchange
At Christmas time, however, we are happy to exchange Christmas gifts until 16 January (this applies to gifts bought November and December before Christmas, which can then be exchanged until the nearest 16 January.)
Refusal of Receipt of delivery from Epic Panda.
If you have placed an order on Epicpanda.de and then refuse to receive the order, or choose not to pick it up at a parcel shop, then this does not count as a 14 days right of return of the purchase, but a cancellation of the order and in such cases Epic Panda is entitled to impose all expenses for freight and more both ways on the customer, so that they are deducted from the amount returned by the customer.
The new consumer legislation
Take the clothes home and try them on
When you buy clothes either from the webshop or one of Epic Panda's physical stores, you are always allowed to try the product at home. However, the prerequisite is that the surroundings you are in do not affect the clothes by e.g. odors such as smoking, traces of use or the like.
Depreciation of product
If you have used or washed the garment, it will create a depreciation of at least 50%. The amount of the depreciation is determined by Epic Panda after the item has been received. This applies to both physical stores and webshops.
Safe return
All goods that are returned must be securely wrapped. Damage because of defective packaging may cause your rights to expire. If an item purchased from Epicpanda.de is wrapped in antistatic material, the item must also be wrapped in antistatic material in the event of a return. If a returned item has been damaged due to lack of wrapping in antistatic material, this will result in the loss of your rights.
Purchase agreement
A binding purchase agreement has not been entered into with Epicpanda.de before you have received an order confirmation, Epicpanda.de does not store the order confirmation after it has been sent to the customer. In the event of stock errors and typing errors, Epic Panda can cancel the purchase agreement, however, Epic Panda will always strive to obtain the goods as soon as possible in the event of such errors and at the same time provide good communication with the customer.
Refund on return.
We will pay back the money on return via original payment method if used, Payment card, Epay or Applepay
If other payment methods have been used, we can only refund via bank transfers.
Pre-order Disclaimer:
We never put more products up for pre-order sale than we have ordered home. However, there is a possibility that there will be a post-allocation from the supplier's side, over which we are not in control. Therefore, it will always be first come, first served with pre-orders. in 9 out of 10 cases we can cover all pre-orders, so the earlier you order the more certain you are of being first in the queue! We therefore reserve the right to cancel pre-orders if external conditions mean that we cannot deliver the product.
ATTENTION:As a rule, we do not split orders, so if you make several pre-orders in the same order, everything will be sent when the last product is released, so if you want to order several products that are released on different days and want them to arrive on the release date, then you place an order per product/release date
Prices
All prices for new products are incl. 19% VAT and in Euro, where nothing else is mentioned. The prices are only valid within Germany's borders. Reservations are made for currency changes, force majeure, delivery failure, tax changes, out-of-stock items and printing errors. The stated price at the time of ordering is the applicable ordering price, and the price does not change either in the event of a price decrease or increase.
Delivery
Any delivery time given by Epicpanda.de is just an estimate. Epicpanda.de reserves the right for sold-out and discontinued items. Epicpanda.de cannot be held responsible for losses, directly or indirectly, from a delay in the delivery of the goods. Nor will a delay entitle the buyer to terminate or cancel the contract, unless the delay exceeds 60 days.
Purchase of delivery
When you place an order with delivery, the delivery agreement is an agreement between you as the customer and the carrier. As a company, we just resell the delivery for you and act as an intermediary and deliver your order to the carrier for you. Any problems arising with a carrier are a matter between you and the carrier. however, we are happy to help as much as we can.
Risk
The risk for goods purchased at Epicpanda.de passes to the buyer at the time of delivery.
Retention of title
Epicpanda.de reserves the right of ownership to the Product as long as full payment for the ordered Product has not been received.
Until ownership has been transferred to the Customer, the goods must be stored and maintained properly. The goods must be stored separately from other goods, so that it is possible to identify the goods as Epicpanda.de's property. Identification labels, prints and the like must not be destroyed or removed from the product or packaging. Damage to the product, in addition to what is caused by usual wear and tear, must be compensated by the customer. The customer undertakes not to, without Epicpanda.de’s written consent, dispose of the goods sold in a way that could impair Epicpanda.de's security in the goods, including pledging, renting or lending the goods.
Reservations
Reservations are made for sold-out and discontinued items, as well as printing and typing errors on the entire Epicpanda.de website.
Promo Campaigns
Max one Promo campaign per customer. Epic Panda reserves the right to remove promo campaigns from orders if the same customer has used the campaign several times.
Trading conditions for B2B Sales
Special provisions for traders
The same sales conditions apply as for consumers, however with the following modification; there is no right of withdrawal for traders, a 1-year right of complaint applies from the original invoice date. Exchange or repair does not result in a new 1-year complaint period running, Epicpanda.de reserves the right of ownership to goods purchased on credit until the full purchase price is paid, all costs in connection with enforcement of the retention of title are the responsibility of the buyer, who accrues interest from the due date with 1.5% per started month.
